The Office of Legal Services (OLS) provides comprehensive legal support and services to the California Department of Public Health (CDPH) programs and leadership to advance CDPH’s mission to optimize the health and safety of all Californians.  OLS is comprised of four legal teams and an administrative team.  This position is for the Operations and Administrative Litigation team that represents the Department in hearings before the Department of Health Care Services, Office of Administrative Hearings and Appeals; Department of General Services, Office of Administrative Hearings; State Personnel Board, and other state Administrative Law forums, and provides administrative litigation support to various programs.  The Operations and Administrative Litigation (OPAL) team also serves as house counsel to the Department's Human Resources Division (HRD), the Office of Compliance (OOC), and offices in the Directorate such as the Office of Communications and Information Technology Service Desk.

Work Location (County): Sacramento; Enhanced telework and flexibility is available for this position in accordance with the Department of General Services’ and California Department of Public Health’s telework policies.

The Attorney will represent the Department in administrative hearings involving personnel actions, appeals of actions to revoke or deny licensure of health facilities and clinics, hospital immediate jeopardy administrative penalty appeals, long term care facility citations, medical breach penalty appeals, the Stop Tobacco Access to Kids Enforcement Act (STAKE) penalty appeals, the Women, Infants and Children (WIC) Program action appeals, the Radiologic Health Program enforcement actions, failure to timely report adverse events in health facility penalty appeals, and other enforcement actions of the Department.

Desirable Qualifications

In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:

The ideal candidate possesses strong litigation experience and skills, knowledge of California state administrative law, particularly the Administrative Procedure Act, and/ or an understanding of public health principals and practice.  The ideal candidates should also have excellent analytical, research and communication skills (both written and oral) as well as a demonstrated ability to prioritize workload and manage multiple projects with short-term deadlines.
